If you cannot meet the financial requirements listed above, then there is another option available to you if you can satisfy the Adequate Maintenance Requirements.
What are the Adequate Maintenance Requirements?
a. You must be a Partner of a British or settled person in the UKor your Parent’s Partner must be a British or settled person in the UK.
b. Your Partner(or your Parent’s Partner) must be receiving one or more of the following: -

- Disability Living Allowance
- Severe Disablement Allowance
- Industrial Injury Disablement Benefit
- Attendance Allowance
- Carer’s Allowance
- Personal Independence Payment (PIP)
- Armed Forces Independence Payment or Guaranteed Income Payment under the Armed Forces Compensation Scheme
- Constant Attendance Allowance, Mobility Supplement or War Disablement Pension under the War Pensions Scheme.
You will need to document any assertion that you receive any of the above allowances by way of official documentation and corroborating bank statements.
c. You will need to meet the Adequate Maintenance Threshold of income. This is a lower threshold than the £18,600 currently required for someone that does not qualify via the Adequate Maintenance Requirements. Yes you can as long as you meet the Home Office criteria. The criteria is very stringent therefore you will need to meet all the requirements to give yourself the best chance of bringing your partner to the UK. We can help determine which requirements you need to meet and what documents are required as evidence. An important element of the criteria is meeting the financial requirements. The current financial requirement at the time of writing is that you need to be earning at least £18600 a year to demonstrate that you have enough funds to support yourself and your partner. The average time is currently 6 months for out of country spouse visa applications. However, this could be shorter if one of the premium services are offered at the time of applying. You should note that the premium services attract an additional fee by the Home Office.
