What is a Non-Fault Divorce?
A no-fault divorce is a much more straightforward and amicable approach to separation. With this new process, couples can file for divorce or civil partnership dissolution without having to place blame on their former partner to prove the irretrievable breakdown.
Why Is a Non-Fault Divorce Different?
Non-fault divorce is a faultless or blameless divorce process. Under the new law, you can now get divorced solely on the basis that the marriage has irretrievable broken down without relying on one of the five facts that was previously required.
Under the previous divorce law, one person have to issue divorce proceedings against the other and prove one of the 5 grounds to establish that the marriage has irretriavbly broken down. This is no longer required.
How Much Does No Fault Divorce Cost?
Our family law solicitors can take you through the divorce process for a fixed fee, giving complete peace of mind.
If you are the person applying for the divorce, our fixed fees start from £600 plus VAT.
If you're the person responding to the divorce, our fixed fees start from £400 plus VAT.
There is also a court fee which will need to be paid to the court by the person making the divorce application. This is currently £593.
Dealing With Finances in Non-Fault Divorce
The non-fault divorce process only brings your marriage to an end. The financial matters arising from your marriage will still need to be resolved. It is important that finances are dealt with at the same time as the divorce.
Should you choose to leave your financial matters unresolved, one person could make a financial claim against the other after getting divorced. Find out more about dealing with finances when a marriage breaks down.
