An uncontested divorce is a divorce which is not being defended (disputed). A contested divorce is more complicated, it costs much more, takes longer, and the divorcing couple usually have to attend two Court hearings. An uncontested divorce is relatively straight forward.

The ground for divorce

The marriage has irretrievably broken down. This is the only ground for issuing a petition for divorce i.e. asking the court to dissolve the marriage. This is proven using one of the facts below.

A party needs to demonstrate that the marriage has irretrievably broken down by proving 1 of 5 facts

  • Adultery
  • Unreasonable Behaviour
  • Desertion for 2 years
  • 2 years separation with the other parties consent.
  • 5 years separation (without consent)

Divorce Petition

A Divorce Petition is prepared stating some background information and the reasons for the divorce.

Divorce papers are completed and filed at Court

The Divorce Petition and the supporting payments are filed at Court and the present fee is £550

Acknowledgement of service

The other party then receives copies of the divorce papers. An Acknowledgement of Service Form is then filed at Court. This must be done within 7 days of the petition being served.

If an acknowledgement of service is not filed within 7 days, an application can be made for the Court to deem that service has been effected if it can be demonstrated that the petition was served.

If service is not deemed to have been effected then personal service may be necessary through the assistance of a process server.

Decree Nisi

A Certificate is obtained from a Judge to confirm that there is an entitlement to a divorce and a date is set for a Decree Nisi (the Interim Divorce Order)

Decree Absolute

This is the final Divorce Order and can be applied for 6 weeks and 1 day after the Decree Nisi. A court is unlikely to grant this without arrangements being place for children.
